“Congratulations on your new bundle of joy! While you’re registering that birth certificate, might we suggest opening a conveyancing file for their future property needs? We can start preparing for their first home purchase… in about 25 years.”

Of course, this is wildly exaggerated, but stay with us – we’re making an important point about timing that could save you significant stress and money.

The Pre-Dream Home Phase

In our conveyancer-ruled universe, the moment the seed of “maybe I should buy a home someday” enters your mind, you’d immediately call your local conveyancer at Mildwaters Byrth.

“I’m thinking I might want to buy a house… eventually. Maybe. Possibly in the next decade.”

Your conveyancer would enthusiastically respond: “Excellent! Let’s get your verification of identity done now, and discuss potential easements and encumbrances on properties you haven’t even considered yet!”

While this scenario brings a smile to our faces, there’s a kernel of truth here. Many people don’t realise that verification of identity (VOI) can sometimes be challenging if you don’t have the right documentation ready. Some clients discover they need to order a new birth certificate or update identification documents, which can take precious time during the already stressful buying process.

The House-Hunting Phase: Where Our Fantasy Meets Reality

Now we’re getting closer to reality. In our conveyancer-ruled world, before attending a single open inspection, you’d consult with your conveyancer about areas you’re considering.

“I’m thinking of looking at houses in Kadina this weekend.”

Your conveyancer would say: “Let me run a full title search on EVERY property in Kadina so you know exactly what you’re getting into before you even step foot in a home.”

While running searches on every property would be excessive, this is where our fantasy starts overlapping with practical advice. If you’ve narrowed down your search to a few properties, it’s actually not ridiculous to touch base with your conveyancer. They can check titles for easements or encumbrances that might affect your decision – especially in newer subdivisions where restrictions on fencing, building design, and other factors are common.

As Anna Przibilla, our Registered Conveyancer, explains: “Encumbrances are more common in new subdivisions. If you drive around the new subdivision at Moonta or any new estate, you’ll notice none of them have front fences. That’s because they’re not allowed to have front fences. At the Dunes, you’ll notice they’ve all been designed with specific house styles because that’s what the encumbrance requires.”

The Cooling-Off Period: A Critical Misunderstanding

In our imaginary universe, the cooling-off period would last for weeks, giving you ample time to consider every aspect of your purchase.

Reality check: The cooling-off period in South Australia is just two business days, and it starts when the agent sends you the Form One – not when you sign it.

This is where many buyers make a costly mistake. As Anna points out: “It’s a common misconception that people think, ‘Oh, they’ve sent me the Form One, I’ll look at it in two days’ time, then I’ll sign it, and then I’ve got my two days cooling off.’ But it actually starts when the agent emails it to you – that’s deemed served. So the two days starts from there, not when you actually sign it.”

In our conveyancer-ruled world, you’d forward that Form One to your conveyancer immediately for review before making any decisions. And in the real world? That’s actually excellent advice.

The Pre-Settlement Phase: Documentation Heaven

In our fantasy world, every document would be prepared months in advance, with multiple reviews and perfect execution. Every “i” dotted, every “t” crossed.

The reality isn’t quite so extreme, but it’s still wise to get your verification of identity completed as early as possible in the process. Some people discover they don’t have the right ID or need to order additional documentation, which can cause delays when time is already tight.

For Vendors: The Clearance Certificate You Didn’t Know About

If conveyancers ruled the world, vendors would apply for their ATO foreign residence withholding clearance certificate the moment they even considered selling.

This isn’t actually far from good practice. As Anna notes: “Every vendor has to apply to the ATO to get a foreign residence withholding clearance certificate. If you’re up to date with everything, they come through straight away within a day or two. Sometimes they can take a week or so. So we tell all vendors to do that as soon as possible, as soon as they’ve either listed the property or signed a contract.”

And when Anna mentions “up to date with everything”, this includes making sure your income tax returns because if you are running behind with them, it can hold up the issuing of the foreign clearance certificate.

Without this certificate, settlement can be delayed or vendors might face withholding tax – something easily avoided with early action.

The Reality: When Should You Actually Contact Your Conveyancer?

So now that we’ve had our fun with fantasy scenarios, let’s be clear about the reality.

The absolute ideal time to contact your conveyancer is immediately after signing a contract to purchase. This gives them time to review everything properly and ensure the process runs smoothly.

However, there are several situations where earlier contact makes perfect sense:

  1. Before signing anything – If you’re unsure about any aspect of the contract or Form One
  2. When you’ve shortlisted properties – We can check titles for potential issues
  3. When you’re planning to bid at auction – Understand your obligations in advance
  4. As a vendor, when you decide to sell – Get advice on that ATO clearance certificate
